Terms of Service

1. Acceptance of Terms

By accessing or using Mamtack ("the Service"), including the visual feedback widget, the dashboard application, and the API, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Mamtack provides a visual feedback widget that allows users to pin comments directly on web pages, along with a dashboard for managing feedback threads, team members, and integrations. The Service is offered through free and paid subscription tiers.

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately at support@mamtack.com if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Post spam, harassment, threats, or abusive content through the widget
• Attempt to gain unauthorized access to the Service, other accounts, or systems
• Interfere with or disrupt the Service's infrastructure
• Reverse-engineer, decompile, or disassemble the Service's software
• Resell or redistribute the Service without prior written consent
• Use the Service to collect personal data from users without their consent

5. Subscription Plans and Billing

Paid plans are billed through Lemon Squeezy, our Merchant of Record. Subscriptions renew automatically. You may cancel at any time; access continues through the end of the billing period. Plan limits (thread counts, features, team seats) vary by tier. Downgrading may restrict access to features or data that exceed the new plan's limits.

6. API Keys and Widget Embedding

Each site project receives a unique API key. You are responsible for keeping your API key confidential and configuring domain allowlists appropriately. Mamtack is not liable for unauthorized use resulting from exposed API keys.

7. Content and Ownership

You retain ownership of content you submit through the Service. By posting content, you grant Mamtack a limited license to store, display, and process that content as necessary to operate the Service. Mamtack does not claim ownership of your feedback data.

8. Intellectual Property

The Mamtack widget, dashboard, documentation, and all related software are proprietary. The widget is distributed under a proprietary license. You may not copy, modify, or create derivative works from the Service's source code except as expressly permitted.

9. Third-Party Integrations

The Service integrates with third-party services including Jira, Linear, GitHub, Slack, and AI providers. Your use of these integrations is subject to the respective third party's terms. Mamtack is not responsible for third-party service availability or conduct.

10. Data and Privacy

Our collection and use of data is governed by our Privacy Policy. By using the Service, you also agree to the Privacy Policy.

11. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance, apply updates, or experience outages. We will make reasonable efforts to notify users of planned downtime.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these terms, with notice when reasonably possible. Upon termination, your data will be deleted in accordance with our data retention practices.

13. Limitation of Liability

To the maximum extent permitted by law, Mamtack and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

15. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or a notice within the Service. Continued use after changes take effect constitutes acceptance of the updated terms.
